The information below outlines our legal terms and conditions (Terms) on which we sell our products (Products) including all those listed on our website (our Site).

These Terms apply to any contract between us for the sale of Products to you (Contract). When you use our site, our Privacy Policy applies. Please read these Terms carefully and make sure that you understand them before ordering any Products from our site.

These Terms and any Contract between us are only in English. Before placing an order you will be asked to agree to these Terms. If you refuse to accept these Terms, you will not be able to order any Products from our site.

We amend these Terms from time to time. Every time you wish to order Products, please check these Terms to ensure you understand the terms which will apply at that time. If ordering Products from our site, you should print a copy of these Terms or save them to your computer for future reference. 1. Information About Us

1.1 We are Plus 3 Performance Limited, a company registered in England and Wales under number 10755920. We provide mountain bike setup and coaching events. Our registered office is that of our accountants, Ground Floor, Manvers Street, Bath, Somerset, BA1 1JQ. We own and operate the website www.plus3mtb.com and are not VAT registered.

1.2 If you wish to contact us for any reason you can do so via email on [email protected] or via phone on (0) 7817 270 225 or via mail on the address listed above.

1.3 +3 operates mountain bike coaching and bike setup events on behalf of a number of partner companies.

1.3.2 In collaboration with Saddleback Ltd we offer coaching events for their range of Intense Cycles bikes and deliver coaching and setup as part of our general event schedule.

2. Our Products

2.1 All images associated with our Products are for illustrative purposes only, as a representation of the locations and environments we operate in. The event that you attend may not use locations or trails referenced in a Product description but will be comprised of similar locations.

2.2 In the case of errors or omissions we reserve the right to alter the specifications of a Product or price without prior notice.

2.3 We quote prices in UK Pounds Sterling including VAT where applicable. The payment page breaks down the total VAT payable for the Product being purchased.

2. Our Products

3. Age of Consent

3.1 As a consumer you may only purchase products on plus3mtb.com if you are over the age of 18. If you are under the age of 18 please make sure an adult places the order on your behalf.

4. Contract Formation

4.1 When placing an order with +3 we will guide you through the necessary steps to complete your order. The ordering process allows you to check and amend orders before payment is processed. If there is an error during your order please contact us on [email protected] and we will do our best to resolve the problem.

4.2 All orders must be placed via the +3 website and we do not accept orders by any other means unless described in writing via email between +3 and a customer. Orders are confirmed only via email.

4.3 Once you place an order with +3 it will be confirmed via email and acknowledge your payment is being processed. If you have any problems during the payment or ordering process then please contact us on [email protected]

4.4 The confirmation of your order forms the contract between you and +3 to provide the services you have purchased for a specified cost. This confirmation also assumes your agreement with all the points defined within these Terms and Conditions and Privacy Policy.

5. Cancellation By +3

5.1 If we are unable to run an event we will endeavour to give you as much notice as possible. The following list defines our procedures that cover the majority of situations:

5.1.1 Adverse Weather – In the event of adverse weather conditions +3 will, in general, run events and advise attending riders to take appropriate precautions when riding and wear appropriate apparel to maintain a comfortable riding experience.

5.1.2 Extreme Weather – In the event of extreme weather conditions, as defined by the Met Office National Severe Weather Warning Service Impact tables.

These include Rain, Thunderstorms, Wind, Snow, Lightning, Ice and Fog and +3 will make a decision on whether an event will run based on the status of Weather Warnings for the day of the event and three days prior.

5.1.3 Cancellation of an event will only occur if Met Office Weather Warnings are at Low, Medium or High levels or if coaching staff are unable to attend due to unforeseen circumstances. Notice of a cancellation will be given at the earliest opportunity but could happen less that 24 hours before the event is due to begin.

5.1.3 Rebooking of an event will be offered to riders when a day is cancelled due to either Adverse or Extreme Weather conditions or a member of staff being unable to attend.

Cancellation By A Customer

6.1 If you are unable to attend a +3 event due to injury or circumstances out of your control +3 will offer a place on a different date. Notification to +3 via email should be made as soon as you are aware that you cannot attend.

6.2 A place on a +3 coaching event (Product) is valid for 12 months from the date of purchase.

6.3 The Product cannot be exchanged for a cash alternative

6.4 The Product can be used by another party should the original rider be unable to attend. Notification should be given as soon as possible via email to [email protected]

6.5 Should a rider no longer wish to attend the Product they have booked then the following cancellation charges apply as a percentage of the total Product cost.

28 days+ = 25%
14-28 days = 50%
1-14 days = 100%

6.6 Extenuating circumstances will be considered in all cases should it be deemed necessary.

7. Exceptions

7.1 Compensation will not be payable, and no liability beyond offering the above mentioned choices, can be accepted where Plus 3 Performance Ltd are forced to make a change as a result of unusual and unforeseeable circumstances beyond our control, the consequences of which Plus 3 Performance Ltd could not have avoided even with all due care, (see Force Majeure).

7.2 Plus 3 Performance’s liability for Major Changes is limited to offering you the above mentioned options and, where applicable, compensation payments. Plus 3 Performance Ltd regrets that it cannot pay any expenses, costs, or losses incurred by you as a result of any change. No compensation is payable for minor changes.

8. Force Majeure

8.1 Compensation will not be payable if Plus 3 Performance Ltd is forced to cancel or, in any way change, your arrangements due to war, threat of war, industrial dispute, riots, civil strife, political unrest industrial dispute, terrorist activity,
natural or nuclear disasters, fire or adverse weather conditions, epidemics, theft, quarantine, medical or customs regulations, technical and administrative problems with transport, closure of airports & train stations, breakdown with
machinery and equipment, water shortages or other unusual and unforeseeable circumstances beyond Plus 3 Performance’s control which could not have been avoided.

9. Equipment

9.1 It is the responsibility of riders attending events with +3 to ensure they participate using the correct equipment. Please see the accompanying notes at the bottom of this page for +3’s recommendations on equipment.

9.2 Bikes must be in excellent working condition with no mechanical faults that could cause the rider to injure themselves or others.

9.3 Riders must wear a helmet that complies with the relevant CE EN1078 and/or CPSC 16 C.F.R. part 1203 and/or AS Standards. Failure to do so may result in serious injury or death.

9.4 +3 is not responsible for any damage or loss of bikes, clothing or equipment resulting from participation in our events. +3 will employ basic security measures during our events if bikes are left unattended but ultimately the security of a customers bike is their responsibility.

10. Event (Product) Costs & Adherences

10.1 All riders attending a +3 event must comply with the rules and regulations of the land owner and facility management.

10.2 All riders attending a +3 event must pay parking charges associated with the facility being used for the event.

11. Insurance & Safety Commitment

11.1 Plus 3 Performance Limited warrants that the service provided during a +3 event is delivered by staff with relevant qualifications as described in clause 11.5.

11.2 Plus 3 Performance Limited cannot accept responsibility for death, injury or illness caused during an event unless it is proved any death, injury or illness was due to the negligence or omission of +3 staff, suppliers or subcontractors whilst carrying out their duties on behalf of Plus 3 Performance Limited.

11.3 +3’s liability (other than our legal liability for loss of or damage to your personal property, personal injury, illness and or death) will be limited to the cost of your event.

11.4 Plus 3 Performance Limited warrants that it has taken all reasonable and proper steps to ensure that the suppliers of the products provided as part of your event are from safe and reputable businesses and that they comply with local and national laws and regulations which apply to the products they provide.

11.5 Plus 3 Performance Limited warrant that all subcontractors engaged to provide services at +3 events are qualified to do so. Qualification may be formed by the completion of National Governing Body training programs and/or a level of experience and understanding deemed to be equivalent by Plus 3 Performance Limited.

11.6 Plus 3 Performance Limited warrants that a minimum of one member of staff or subcontractor staff holds an up to date 2 Day Outdoor First Aid certificate and that person is willing and physically able to carry out First Aid procedures.

11.7 If you and any member of your party suffers illness, injury or death and it is proved this is due to negligence or omission of +3’s employees, agents or suppliers, you must tell +3 or the supplier involved about your illness or injury whilst you are at the event location and write to +3 within three months with details.

11.8 +3 recommends that riders attending an event have their own personal insurance to protect against loss of earnings, medical care and personal affects that may result from an injury sustained during a +3 event.

12. Legal Procedure

12.1 All matters arising from these Booking Conditions are governed by English Law and subject to the jurisdiction of the courts of England & Wales.

13. Equipment Recommendations

+3 recommends all riders wear the following equipment during our events, these recommendations are exactly that and failure to be adequately equipped is the responsibility of the rider.

13.1 Helmet – Generally an ‘open-face’ style helmet is sufficient for taking part in +3 events unless they are specifically stated as Downhill Events. If so then a rider must wear a ‘full-face’ helmet.

13.2 Gloves – Full finger gloves are recommended for +3 events and we do not recommend open finger gloves for any of our events.

13.4 Footwear – If riding with Flat pedals then a rubber soled shoe designed specifically for mountain biking is recommended. If riding clipped in then again, an appropriate shoe with a cleat in good condition is recommended.
